1. Definitions
In these Terms & Conditions, the following terms carry the meanings assigned below:
- "Agreement" means these Terms & Conditions together with any service engagement letter or written confirmation between us.
- "Service" means any of the three services offered by Kebun Lodge: Garden District Residence Search, Lease Review and Finalisation, and Garden Estate Custodianship.
- "We", "Us", "Our" refers to Kebun Lodge, registered in Singapore, with a principal address at 28 Ridout Road, Singapore 248423.
- "You", "Client", "User" refers to the individual or entity engaging our services or using our website.
- "Content" means all materials on our website, including text, images, and property portfolio documents.
2. Acceptance of Terms
By submitting an enquiry form, engaging a service, or otherwise interacting with Kebun Lodge, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions.
You must be at least 18 years of age to engage our services or enter into any agreement with us. By using our website or submitting your details, you confirm that you meet this requirement and have the legal capacity to enter into a binding agreement.
These Terms are governed by the laws of the Republic of Singapore. Any dispute arising out of or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the Singapore courts.
3. Service Description
Kebun Lodge offers three distinct property services in Singapore:
3.1 Garden District Residence Search — SGD 210
Identification of suitable rental properties in Singapore's garden residential districts, with landscape assessment and curated portfolio delivery. This service does not constitute legal, financial, or property valuation advice.
3.2 Lease Review and Finalisation — SGD 690
Review of a proposed residential tenancy agreement and coordination of amendments. This service is administrative in nature and does not constitute legal advice. Clients requiring formal legal opinion on lease terms should engage a Singapore-qualified solicitor.
3.3 Garden Estate Custodianship — SGD 1,460 per month
Ongoing coordination of interior and exterior property maintenance on behalf of the tenant, including landscape, pool, and home administration services. This service is management and coordination in nature. Kebun Lodge acts as a coordinator between the tenant and third-party contractors and does not carry out physical maintenance work directly.
Service availability is subject to our current capacity. We reserve the right to decline to accept new engagements at our discretion without providing reasons.
4. User Responsibilities
When engaging with Kebun Lodge, you agree to:
- Provide accurate and complete information relevant to the service engaged
- Respond to our communications in a timely manner to allow service delivery
- Use our services and website in good faith and in accordance with Singapore law
- Refrain from using our website or content for any commercial purpose without written permission
- Not attempt to gain unauthorised access to our systems or data
5. Intellectual Property
All content on the Kebun Lodge website, including property portfolio materials, text, images, and documents prepared in the course of service delivery, is the intellectual property of Kebun Lodge unless otherwise stated.
You are granted a limited, non-exclusive, non-transferable licence to access and use our website content for your personal enquiry and tenancy purposes only. You may not reproduce, distribute, or create derivative works from our content without written permission.
6. Payment Terms
Service fees are payable in Singapore Dollars (SGD) as follows:
- Garden District Residence Search: SGD 210, payable upon engagement confirmation
- Lease Review and Finalisation: SGD 690, payable upon engagement confirmation
- Garden Estate Custodianship: SGD 1,460 per calendar month, payable in advance on or before the first day of each service month
Payment may be made by bank transfer to the account details provided in our engagement confirmation. Services will commence upon receipt of cleared funds.
Refund policy: For the Garden District Residence Search and Lease Review services, fees are non-refundable once the service has commenced. For Garden Estate Custodianship, the service may be terminated by either party with 30 days' written notice. Fees paid for the notice period are non-refundable. No refunds are available for custodianship fees paid in advance beyond the notice period.
7. Disclaimers
Our services are provided in good faith and with professional care, but we cannot make the following assurances:
- That any particular property will be available, suitable, or available at a specified price
- That a lease review will prevent all possible future disputes with a landlord
- That third-party contractors coordinated under custodianship will perform without any defect
The Lease Review and Finalisation service is an administrative and advisory service. It does not constitute legal advice. Where legal advice is required, we recommend engaging a Singapore-qualified solicitor.
8. Limitation of Liability
To the fullest extent permitted by Singapore law, Kebun Lodge's total liability to you arising from or in connection with any service or these Terms shall not exceed the amount paid by you for the relevant service in the preceding three months.
We shall not be liable for any indirect, consequential, or special loss, including loss of tenancy opportunity, loss of profits, or property damage arising from third-party contractor actions, except where such exclusion is not permitted by applicable Singapore law.
9. Termination
Either party may terminate a service engagement by written notice in accordance with the notice periods set out in the relevant service terms. For custodianship, 30 days' notice is required. For the search and lease review services, termination prior to commencement may be arranged by contacting us directly.
We reserve the right to suspend or terminate a service engagement immediately if we have reasonable grounds to believe a client has provided false information or is acting in breach of these Terms.
10. Dispute Resolution
In the event of a dispute, we ask that you first contact us at [email protected] so that we can attempt to resolve the matter informally and in good faith within 30 days of written notice.
If informal resolution is not achieved, the dispute shall be resolved by the courts of the Republic of Singapore, which shall have non-exclusive jurisdiction. These Terms are governed by and construed in accordance with Singapore law.
11. Changes to These Terms
We may update these Terms & Conditions from time to time. Any changes will be published on this page with an updated effective date. Continued use of our website or services after the effective date of a revision constitutes your acceptance of the updated Terms.
